These Terms of Use (“Terms”) govern your access to and use of hopewithoutborders.net and related online features operated by Hope Without Borders (“HWB,” “we,” “us,” or “our”), including contact forms, donation links, newsletter signups, volunteer opportunities, program information, stories, and other content (collectively, the “Site”).
1. Acceptance of these Terms
By accessing or using the Site, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Site. Additional terms may apply to a specific donation platform, event, volunteer role, program, or service.
2. About Hope Without Borders
HWB is a humanitarian nonprofit initiative focused on restoring hope, protecting human dignity, strengthening communities, and supporting individuals and families affected by persecution, conflict, displacement, censorship, medical need, trauma, and humanitarian crises.
Descriptions of programs, goals, impact, campaigns, and projected uses of funds are provided in good faith and may change as needs, safety conditions, available resources, partnerships, or legal requirements evolve.
3. Eligibility
You may use the Site only if you can legally agree to these Terms. If you are under the age of majority where you live, you may use donation, volunteer, application, or submission features only with the involvement and permission of a parent or legal guardian.
4. Permitted use of the Site
You may access and use the Site for personal, informational, charitable, and other lawful purposes consistent with HWB’s mission. You may print or share public Site materials for noncommercial purposes if you preserve attribution and do not alter the meaning or context.
5. Donations and recurring gifts
When you make a donation, you represent that you are authorized to use the selected payment method and that the information you provide is accurate. Donations may be processed by an independent payment provider, whose terms and privacy notice also apply.
Unless a campaign states otherwise, donations support HWB’s charitable mission and may be used where the need is greatest. We will make reasonable efforts to honor a stated campaign designation, but we may redirect funds when a program is fully funded, cannot be carried out safely or lawfully, or circumstances make another charitable use more effective, provided the redirected use remains consistent with HWB’s mission and applicable law.
Recurring donations
If you choose a monthly or other recurring donation, you authorize the payment provider to charge the selected amount at the disclosed frequency until you cancel. You may request cancellation through the payment provider or by contacting us. A cancellation may not reverse a charge already submitted for processing.
6. Donation errors and refund requests
Charitable donations are generally final. If you believe a donation was made in error, duplicated, unauthorized, or charged in the wrong amount, contact us promptly at info@HopeWithoutBorders.Net. We will review requests in good faith. Any refund is subject to applicable law, payment-provider rules, transaction status, and the circumstances of the request.
7. Tax status, deductibility, and donation acknowledgments
Current status: HWB is awaiting IRS recognition under Section 501(c)(3). The deductibility of a contribution may depend on the timing and outcome of the application, applicable law, and the donor’s individual circumstances.
Nothing on the Site is tax, legal, or accounting advice. Do not assume that a donation is tax-deductible unless supported by applicable law and appropriate written documentation. Donors should consult their own qualified advisers.
Where applicable, HWB or its payment provider may issue a donation acknowledgment. You are responsible for keeping records needed for your tax filings. The fair market value of any goods or services provided in exchange for a payment may reduce the deductible portion.
8. Volunteer, event, and program activities
Submitting a volunteer form, application, inquiry, or expression of interest does not guarantee selection, placement, participation, assistance, funding, employment, or any other benefit. HWB may establish qualifications, screening, training, confidentiality, safety, conduct, and background-check requirements appropriate to a role or program.
Volunteers are not employees merely because they use the Site, communicate with HWB, or participate in a volunteer activity. Separate written agreements or policies may apply.
Humanitarian work may involve changing or sensitive conditions. HWB may modify, postpone, cancel, restrict, or end an activity when reasonably necessary for safety, security, resources, legal compliance, or program effectiveness.
9. Email and other communications
When you subscribe or otherwise consent, we may send stories, program updates, volunteer opportunities, humanitarian news, event invitations, and fundraising communications. You may unsubscribe from marketing emails at any time using the link in the message. We may still send non-marketing communications related to a donation, request, safety issue, or service interaction.
10. Intellectual property
The Site and its original text, design, graphics, logos, photographs, videos, audio, compilations, and other materials are owned by or licensed to HWB and are protected by applicable intellectual-property laws. Except as expressly permitted, you may not reproduce, publish, modify, distribute, sell, license, scrape, or commercially exploit Site content without prior written permission.
“Hope Without Borders,” related names, logos, and campaign identifiers may be trademarks or service marks. No license to use them is granted except with written authorization.
11. Stories, photographs, feedback, and other submissions
You retain ownership of content you submit. By voluntarily submitting non-confidential content for publication or promotional use, you grant HWB a worldwide, nonexclusive, royalty-free license to host, reproduce, edit for length or clarity, translate, display, publish, and distribute that content in connection with our mission, subject to any written limitations we accept.
You represent that you have the necessary rights and permissions and that your submission does not violate another person’s privacy, confidentiality, safety, copyright, or other rights. Do not submit a beneficiary’s name, image, story, medical information, location, political affiliation, or other sensitive information without informed authorization and an appropriate secure process.
We may decline, remove, anonymize, or stop using submitted content at our discretion, including for safety, dignity, accuracy, or legal reasons.
12. Privacy
Our collection and use of personal information are described in our Privacy Policy. By using the Site, you acknowledge that internet transmissions and online storage cannot be guaranteed to be completely secure.
13. Prohibited conduct
You may not:
- use the Site for unlawful, fraudulent, abusive, threatening, harassing, discriminatory, or exploitative purposes;
- misrepresent your identity, affiliation, authority, or the purpose of a donation or request;
- impersonate HWB, a staff member, volunteer, partner, donor, or beneficiary;
- interfere with Site operation, attempt unauthorized access, introduce malware, probe security, or evade technical controls;
- collect personal information from the Site through scraping, harvesting, or automated means without authorization;
- publish or transmit information that could expose a beneficiary, volunteer, donor, or partner to retaliation, surveillance, discrimination, or physical danger;
- use HWB’s name, logo, content, or reputation to solicit funds without written authorization; or
- help another person engage in prohibited conduct.
14. Third-party websites and services
The Site may link to payment providers, social networks, partner organizations, maps, video platforms, or other independent services. Links are provided for convenience and do not necessarily imply endorsement. HWB does not control and is not responsible for third-party content, availability, security, privacy, fees, or practices.
15. Informational and service disclaimers
The Site is provided on an “as is” and “as available” basis. To the fullest extent permitted by law, HWB disclaims warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, availability, and security.
Site content is general information and is not medical, mental-health, legal, immigration, financial, tax, emergency, security, or professional advice. HWB is not an emergency-response service. In an immediate emergency, contact the appropriate local emergency services or qualified professional.
We do not guarantee that a donation, volunteer request, program inquiry, communication tool, external resource, or proposed assistance will produce a particular outcome or remain continuously available.
16. Limitation of liability
To the fullest extent permitted by law, HWB and its directors, officers, volunteers, advisers, partners, licensors, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, loss of data, loss of opportunity, or loss arising from Site use, inability to use the Site, third-party services, reliance on Site content, or unauthorized access.
Where liability cannot legally be excluded, it will be limited to the greater of the amount you paid directly to HWB through the Site during the six months preceding the event giving rise to the claim or $100. Some jurisdictions do not allow certain exclusions or limitations, so parts of this section may not apply to you.
17. Indemnification
To the extent permitted by law, you agree to defend, indemnify, and hold harmless HWB and its directors, officers, volunteers, advisers, and service providers from claims, liabilities, damages, losses, and reasonable costs arising from your unlawful use of the Site, violation of these Terms, or infringement of another person’s rights.
18. Suspension or termination
We may restrict or terminate access to the Site or particular features when reasonably necessary to protect users, beneficiaries, HWB, partners, systems, or legal rights, or when we believe these Terms have been violated.
19. Governing law and disputes
These Terms are governed by the laws of the State of New York, without regard to conflict-of-law principles. Subject to any rights you cannot waive under applicable law, disputes relating to these Terms or the Site will be brought in the state or federal courts located in New York County, New York, and you consent to their jurisdiction.
Before filing a formal claim, you agree to contact us and make a good-faith effort to resolve the issue informally.
20. Changes to the Site or these Terms
We may update the Site and these Terms from time to time. The revised Terms become effective when posted unless a later date is stated. Continued use of the Site after an update constitutes acceptance of the revised Terms.
21. General provisions
If any provision is found unenforceable, it will be modified to the minimum extent necessary and the remaining provisions will remain in effect. Our failure to enforce a provision is not a waiver. These Terms, together with incorporated policies and any applicable specific terms, constitute the agreement regarding your use of the Site.
